Terms & Conditions of Comfort PlansA) These plans will automatically terminate without refund if the customer fails to have the Company supply all the customer’s heating oil, discontinues doing business with the Company, or if anyone other than the Company should render service to the burner and equipment or if payments for oil, service, or Comfort Plan are not made in accordance with Company’s regular credit terms of Net 30 Days. Automatic fuel oil delivery by the Company is a requirement for acceptance of these Comfort Plans. A minimum annual purchase of 500 gallons is required to be eligible for these plans. B) Unless the customer, at least 30 days prior to contract anniversary date of each year, notifies the Company in writing of its desire to terminate these Plans on such date, these Plans shall renew themselves as of contract anniversary date of each year. The Company shall have the right to cancel these Plans without any liability when issued in error. C) The Company shall not be responsible for any delays in service, repairs or replacements resulting from conditions beyond its control (such as strikes, war, flood, flooded cellar, hurricane, freeze, power failure, tank leakage, carelessness or negligence on the part of customer, inability to secure technicians or parts, acts of God or any other cause outside of its control). D) All heating equipment is subject to inspection and approval for acceptance. The Company cannot credit any charges for labor and/or materials arising from services performed before acceptance of these Plans. Any pre-existing defective condition of heating system is customer's responsibility and will be excluded from Comfort Plan privileges. These Plans are not refundable. E) The Company is not responsible for the cost of removing and replacing materials relating to concealed pipes, ducts, storage tanks, oil lines and other components of an oil-powered heating system in walls, ceilings, floors, underground, etc.. Any pot type or obsolete units and any plumbing, either hot or cold water-piping, are not covered under these Plans. “The Supreme Plan” does not cover materials or labor required to repair leaking boilers, whose integrity to hold water relies on rubber gaskets between cast iron sections (i.e. H.B. Smith, Weil McClein), or steam boilers, or units older than 10 years. The decision as to whether to repair or replace any part required hereunder rests with the Company. The Company shall not be responsible for repair or replacement of obsolete or unavailable parts or equipment no longer manufactured. Replacement of equipment because of unavailability of parts is the customer's responsibility. F) Air conditioning units, plus any components used in the air conditioning mode, electric air cleaners, media air cleaner cartridges, and outdoor temperature sensing devices are not covered by these Plans. These Comfort Plans do not include material or labor to repair power vent systems. Labor and parts for these items will be billed at our prevailing labor rates. Corrosion to equipment, parts, valves, piping, etc., caused by antifreeze in the system, is excluded from coverage. Replacement of these items will be billed at prevailing rates for material and labor services performed. These Comfort Plans do not include any asbestos abatement, removal, or any pollution clean-up or remediation, plumbing work, chimney failures, soot damage, puff backs, or any consequential damage. G) Secondary heating systems such as any wood and/or coal stoves or portable heaters connected to boiler/furnace smoke pipe automatically cancels these Plans. No parts, controls, motors, or labor for any repair to power venters are covered by these plans. All power venter repairs are billed at prevailing labor and material rates. H) These Comfort Plans provide labor which is limited to the repair or replacement of parts listed, during normal business hours (8:00am - 4:30 pm Monday - Friday). Labor for after hours calls is limited to absolute emergency calls: no heat in freezing weather, exhaust in house, or substantial fuel leaks. Any non-emergency labor for calls after hours will be billed at prevailing rates. Annual tune-ups must be scheduled by the customer and performed between 8:15 am and 3:15 pm Monday - Friday. Any desired alterations, modifications or additions for or to an existing oil burner are not part of these Plans. These plans do not include service required as a result of the customer’s failure to replace fuse, reset circuit breaker, set thermostat properly, turn on emergency switch and no oil (except customers on automatic deliveries). Labor and parts for these items will be billed at our prevailing rates. These comfort plans do not include labor or materials to repair or replace frozen oil lines, frozen heat pipes, frozen water pipes, or unoccupied or unattended properties. I) Purging of air from system, venting radiators, etc., is only covered by the Supreme Plan. J) Optional indirect water heater coverage excludes replacing water tank or heat exchanger, if out of manufacturers’ warranty. Coverage is limited to piping, valves, controls, pumps, water flow control assemblies, and electrical components. K) The customer is responsible for safe access to driveway, heating equipment, and utility area. Work areas must be safe and sanitary for work personnel. Company reserves the right to refuse to work in unsafe or unsanitary conditions.
